Beware of McCain's Freedom-Destroying Dietary Supplement Regulatory Bill PDF Print E-mail

Garlic capsulesMost are familiar with those commercials on television promoting prescription drugs that supposedly offer relief from a variety of ailments, if one would only pressure one’s doctor to obtain them. They have become a source of great entertainment and amusement to some, the kicker coming at the end of each commercial when the FDA-approved medication’s obligatory litany of warnings and dangerous side effects is recited: “Tell your doctor if....” and “Side effects may include.....” Some of the warnings are mild like diarrhea and constipation, some list serious effects like cancer or tuberculosis, and others admit that sometimes even death can result.

The point here is that these are all FDA-approved drugs being advertised and used extensively. Drugs that can cause serious diseases like lymphoma. Drugs that can kill. The FDA’s dismal safety record is well documented; even PBS ran a Frontline special that investigated and exposed the FDA’s unsafe drug record, the influence of Big Pharma inside the FDA, and lack of long-term testing and medical review of many, many dangerous drugs. The FDA seldom removes a drug from the market even after it proves to be harmful or deadly, however they do post quarterly reports with details of the latest potentially dangerous side effects of drugs currently under investigation.

Nonetheless, Senator John McCain (R-Ariz.) wants this same FDA, with its dismal safety record, to regulate dietary supplements. The Dietary Supplement Safety Act (DSSA), S. 3002 (text of this bill posted on Senator McCain's website), that McCain has introduced with one cosponsor, would repeal key provisions of the Dietary Supplement Health and Education Act (DSHEA) to “more effectively regulate dietary supplements that may pose safety risks unknown to consumers.”

Under attack by the DSSA is the once-protected field of supplements, as they have always been considered food. Potencies would have to be reduced to comply with what appears to be a plan modeled after the European Food Safety Authority. A new list of “Accepted Dietary Ingredients” would be “prepared, published, and maintained by the Secretary,” in the future. That’s a bit like being handed a blank check and told to fill it out later as one wishes. It could certainly be used to severely limit access to, and even production of, hundreds of life-sustaining and essential mineral, herb, and vitamin products.

All ingredients contained in each supplement would have to be disclosed at the time the company registers all of its “manufactured, packaged, held, distributed, labeled or licensed,” products with the FDA. An onerous burden would be placed on the shoulders of suppliers and retailers of dietary supplements, as they would have to “obtain written evidence” from the seller that the product is registered as required by law, and keep that documentation on file. Monetary penalties for non-compliance “may, in addition to other penalties imposed in this section, be fined not more than twice the gross profits or other proceeds derived from the manufacture, packaging, holding, distribution, labeling, or license of such dietary supplement.”  Those are very broad dictates and most likely subject to even broader interpretation.

The McCain bill would change existing mandatory serious adverse reporting regulations, requiring minor adverse effects to be reported as well so that the FDA could arbitrarily pull supplements off the shelves or reclassify them as drugs. This immediate recall authority would be granted to the “Secretary upon determination,” that there is a “reasonable probability”  that the product is “adulterated” or “misbranded.” Adulterated in this bill takes on a whole new expanded definition: “A dietary supplement which contains a new dietary ingredient shall be deemed adulterated under section 402(f) unless there is a history of use or other evidence of safety.”  The development of new products that contain newly discovered nutritional components may be entirely quashed.

The hypocritical contrast between the regulation of drugs that can kill and the proposed hyper-regulation for food products -- vitamins, minerals, herbs -- is as plain as the nose on everyone's face.

A Pandora’s box of intended and unintended legal complications and government harassment of nutritional supplement manufacturers and sellers could very well be unleashed if this bill is passed. There are already existing laws on the books that protect consumers from misbranded, fraudulent, or contaminated products. Granting the FDA additional regulatory authority over nutritional supplements seems a bit suspicious, especially considering the influence the enormous pharmaceutical industry has wielded over the research, development, and approval process inside the FDA. Let’s face it, the FDA has been no friend and often has been positively antagonistic toward the nutritional supplement industry. Therefore one wouldn’t set the wolf to guarding the sheep without dire consequences.

In this perverted overly-regulated country, food is now toxic, and drugs and chemicals are safe for ingestion, no matter the harm that results. This inversion should remind us that those who best have the consumers health and safety interests at heart are the consumers themselves. It is big government that has a proven track record of not protecting the public.  And it is big government that is seeking to take away yet another individual freedom, the right to choose one’s own treatment. (Where is the pro-choice crowd on this one; the ones that claim, “my body, my choice?”)

Contact your federal legislators and urge them not to cosponsor, support, or vote for such a power-grabbing, bill. Let them know Americans want unrestricted access to nutritional supplements, and the government out of their health choices.

Sen. McCain described his bill as a “no brainer.”  For constitutionalists it’s a “no brainer” that it should be rejected for the dictatorial, power-grabbing, choice-limiting attack on the nutritional marketplace and individual freedoms that it is.

This bill certainly is supportive of the notion that John McStain is lacking a brain. It does appear that no rational consideration was given to the Constitution during the composition process. No thought was given to the need or the impact, either. No consideration was given to the ineptitude and corruption of the FDA. Perhaps the ONLY thing considered was the increase in bureaucratic control and meddling of dietary choice.

This goes along with the supplement control the EuroZone is trying to impose on it's citizens, but in this USA case big Pharma is going to make out even bigger as folks here must rely on supplements to a greater extent than Europe to try to stay well. If this goes through we'll all pay more in one way or another (supplement cost & poor health).

At the risk of sounding like a radical I would like to remind everyone what the mandate of the FDA is.
It is not to protect the health of the citizens of the United States but rather, to allow the pharmaceutical industry to prosper. It should certainly seem strange to anyone why both food and drugs are under the umbrella of one organization. It's less strange if one considers that virtually all disease in the modern world is caused by poor nutrition and stress. By having control over the foods we consume the FDA is at the same time ensuring a large market for the pharmaceutical firms that if not directly, indirectly control the FDA.
A true patriot would revolt against such draconian bills.

The FDA, which is staffed by former big pharma employees, cares nothing for the people who pay their salaries. Their only mission in life is to allow the pharmaceutical companies to farm us like animals. They restrict our use of physicians and therapies that actually treat the causes of illness so that we will remain ill and be forced to rely on their useless and harmful chemical monstrosities. Valid, well done research showing the safety and effectiveness of so called "alternative" therapies (anything big pharma can't patent) are either ignored or ridiculed. Physicians go along with this out of laziness, ignorance, and/or fear of retribution if they stray from the officially sanctioned "standard of care" (always and only designed to benefit big pharma and not the patient). So now our own government not only strips us of the benefits of our labor through confiscatory taxes, legislates what we can think and say, interferes in the ability of parents to raise their children as they see fit, and in a thousand other ways robs us of the freedoms handed down to us by the Founders but also makes it possible for an industry to keep us chronically ill for financial gain. What a disgrace! Surely there is a special place in hell for people so heartless, greedy, and self serving. Shame, shame on John McCain and his partners in crime in the congress, the FDA, big pharma, and those of us who willingly put our necks in their yoke (people of Arizona: Are you listening?). Seems like every year someone tries to slip control of our suppliments over to the FDA so that soon we will vote the way of CODEX (if you don't know about that, google it) and all vitamins will be in control of doctors. Think of that--you want to buy some Vitamin C and you spend $100 to go to the doctor for a prescription.

No one has ever died of taking vitamin suppliments that I have hear of. Do you see headlines that say, local man dies of swallowing too much Aloe Vera?

If congress thinks there is a health care problem in this country going on now that it can't afford, I would hate to see how much worse it would be if so many of us weren't paying for our own health care by using the very suppliments that they are trying to control.

One of the readers (AJ) posted this comment. "Many dietary supplements have been shown to have no positive health effects whatsoever, and some have even been shown to have negative effects, but because they are classified as "food" they are not subject to regulations that would otherwise require that they at least bear clearer labels describing their actual effects. The "natural supplement" industry is just another racket, getting consumers to spend their hard-earned money on snake oil when what we all really need is to be more active and to eat more vegetables and less red meat. I certainly hope there will be an outcry as, yet another, attack on our free choice to take supplements if we desire. The FDA, which is in the corner of Big Pharma, not ours, would love nothing more than to shut down the natural supplement market. It seems that this is one area where I do agree with the FDA. Anti-biotics should not be left in the hands of the public. The public does not have the knowledge to know when and when not to use them.

Another reason not to support McCain in the Primary

There is a question as to how effective these supplements/vitamins are - because many Americans seen to live quite well without taking a single vitamin/supplement. There is also a question as to how much harm they do as well. If someone wishes to spend their money on supplements, and it turns out that they are wasting money, that is their choice.
Some things are so minor and harmless in nature that they are not worth regulating - and certainly not worth growing the government over. Vitamins fall into that category.
This is another reason that McCain should not be returned to the Senate, and its time for Arizonians to replace him with J.D. Hayworth.

when he was leaving a radio station in Phoenix. Here are some direct quotes of thigs he said when no cameras were around. He said, "two people died because they didn't know what they were taking." Last time I checked, all the supplements (minus vitamins, etc) that promise chiseled abs, superior weight loss, and the other miracles all have "These results not evaluated by the FDA" on them which means they can say that the product does whatever they want to push. The problem with most doctors and scientists when it comes to herbs, natural medicine, vitamins, is that they don't know much about them nor are they interested. My doctor eulogizes his prescription drugs to me while noting a minor study on an herb that didn't work out well in a double blind test. I wonder to myself, if anyone in the test got better and how many people were in it and who conducted it? To be honest, the medical industry favors pharma and drugs even when herbs, German doctors use some herbs often, do the job and have fewer, if any side effects. For example, after my prostate operation, which didn't work, I had difficulties urinating. My specialist prescribed a drug which had severe side effects and didn't work. He essentially gave up on me. Then I found a cure for my swollen gland with a lowly herb -- saw palmetto. If I hadn't found it, I would have had to retire two years earlier, and I would have had to undergo another operation to remove the gland entirely. That is only one example. However, be it known that all people are different and require different amounts of vitamins and kinds of herbs for their individual cures. Doctors love to generalize and give everyone the same daily requirement, for example, vitamins. This is an absurd way of healing. Thus I feel Senator McCain is dead wrong on this issure, and we should stand for our basic rights of defending our own lives from diseases. Life, liberty, and pursuit of happiness? Where did those ideas go?

To be honest, I am more of a libertarian then democrat or republican and I voted for McCain. I am not appalled by this idea as many others are. I have not read the bill but I am assuming it is more geared towards the bad supplements or 'scam' supplements and I view this as more of a consumer protection act than more of an infringement of our freedom. I buy supplements because I am interested to see what the effects are, and I think with the help of peer reviews that the supplement industry has created its own self-monitoring system, but it still bugs me every time I see an extenze commercial on TV or when I see testosterone products that do nothing that people spend $100's of dollars on every year. I think this is what that bill is geared towards - making it so false advertising doesn't sucker in billions of dollars. If you want to spend your money on products that don't work (keep in mind placebo is a great one that works), then I see why you are against this bill. I don't think it will cause the 'banning of supplements' like others have said but will provide some guidelines for regulation. Keep in mind, I am with the majority here in that I don't want government in my life, but think about all of the people that have no idea what they are doing feeding money into products that don't work. I know I have spent $100's on some of these by the advertising claims and my own greed to help me believe they work. The problem with supplements is there are too many claims with not enough supporting information. I just think that this may be the right idea towards starting to at least set a bar where supplements can enter the industry but at the same time to create something this big this soon I can see where people will get frustrated with this. I would rather know what I am buying will work is why I agree with this.

This bill is a great idea and doesn't hurt your freedom at all. Vitamins will still be available over the counter like buying Tylenol. The trouble with supplements and why they need to be regulated is if your bottle says it contains 100mg of Vitamin C or whatever, no one has ever checked first, if it is really 100mg or even Vitamin C, it could be anything. Most people are just ripped off. They supplement industry can do whatever they want. I have read read studies and found that in ginko bilboa pills, which can be dangerous, even pills in the same bottle were very different. People die all the time from supplements. It just doesn't make the news and is way underreported. Basically the vitamin industry has a lot of people getting ripped off, because some brands of vitamins are not what they say and people are getting ripped off. No prescription necessary, just honesty and quality from the companies. But most of you also probably believe Kevin Trudeau and even buy his ridiculous books, so good luck with that

Can we send him back to Hanoi? I and two of my sons struggled with M.R.S.A. for over a year and all the doctors could do was prescribe more antibiotics. It would clear up as long as we took antibiotics but it kept coming back. Then I read Kevin Trudeau's book "Natural Cures They Don't tell You About" We started eating organic food, cut out milk and sugar and refined foods and took supplements. The M.R.S.A. went away immediately and that was five years ago. Now this knucklehead wants to place vitamins and supplements under the control of the government? I pray he doesn't get his way.

While the FDA sometimes goes to far (as in their actions against Vioxx and Zelnorm) supplements give people false hope and bilk the credulous of their money. This is so wrong. My 92 year old father told me this was coming last year and I didn't believe him. He's been taking supplements for fifty years and it's been about that long since he's even visited a doctor. He is on no kind of medication whatsoever. He told me if he couldn't get his whole food supplements it would be his death sentence. My father isn't even on Medicare. He declined it about 20 years ago. FDA is not prefect, but is better than the wasted money of untested, unsafe, natural cures.

I trust the real medicine because it has been double-blind tested; I distrust the many vitamins and holistic cures that have not been tested. Scientifically tested medicine will have an effect upon the body. Supposed holistic cure-alls with no side effects probably cures supposed illnesses. A physics professor I know once asked me if any prescription or natural medication that had no side effects could have any effect at all? The logical answer he was implying was of course, no.

I have a friend who sent his 3 daughters through U.S.C. ($80,000.00 per year times 3 girls times 4 years!), by daily trips to the beach to collect, grind, and bottle seashells as Natural Calcium. What a scam. As far as I know, he is still making his living this way, but he is now buying his shells in larger quantities from someone. There are many innocent people falling for his scam.

And one of my favorite uncles died of cancer leaving much, much less money to my aunt due to the expensive and false hope of Chelation Therapy. Another scam....

As much as I hate and distrust governmental agencies, I would rather a group of anal bureaucrats inspect my medicine than nobody.

No need for this legislation

There are several things people here are missing. First, we don't even NEED this legislation. We can form an organization like Underwriters Laboratory, that can rate supplements. They can give a stamp of approval to those that are what they claim to be, back up their claims about efficacy with medical papers (yes, there are lots of those), and aren't adulterated with things like magnesium stearate. Such an organization would do far, far better than the FDA, which has sold us down the river time and time again. The FDA is completely corrupt. It has allowed monosodium glutimate and artificial sweeteners (toxic poisons) in our food, many different chemicals like preservatives, genetically modified "foods" (WITHOUT a label), growth hormones in our milk and meat, toxic pharmaceuticals (which are sold to brainwashed doctors), and who knows what all else.

People should READ the bill. Any supplement which has not been used heretofore would automatically be called "adulteration." This would put the supplement industry out of business. And then what would I do to preserve my health? I am alive and well because of supplements and alternatives. Instead of being unable to walk, as I once was, I have earned a second degree black belt in taekwondo.

Many of these herbs have been tested, not for a mere few years on a small population, but for HUNDREDS if not THOUSANDS of years, on millions of people. But their experience has no value in the eyes of people like McCain and the other people who want big nanny government in all our lives. If you don't trust supplements, don't buy them!

The biggest thing McCain and his ilk could do to protect us from the real scams would be to outlaw multi-level marketing. You will find the vast majority of false claims about contents, efficacy, and so forth, are coming out of these companies.

I take many vitamin pills and supplements every day. These include the three referred above. I do not want the Federal government including the FDA telling me what I should take or not take. The Federal Government is not my nanny.

Without oversight and regulation, these providers of dietary supplements have been able to circumvent rules that apply to legitimate medicines, allowing them to promise results that are absolutely ridiculous. They're profiting off of the desperate and gullible. I know at least 3 people with cancer that were told to go home by the hospitals and prepare for the inevitable, we have done all we could. We cut, burned and chemo'd but the cancer is still there. These people are now cancer free for 10yrs+ using alternative therapies including vitamins and herbs. I still want this choice if it comes down to it.

If you read pubmed at all, or actually look into the benefits of using a supplement, you'll see that 1000mg of vitamin c increases your risk of kidney stones. Nobody needs that much vitamin c at once. The weight loss drugs? Most of them are bunk and the idiots that want supplements pay for them for an easy fix rather than walking and dieting. The guy at the GNC counter, a "supplement expert" with his associates degree in general studies knows as much about supplements as the company that produces them wants him to know. Speak with your pharmacist about what you really need and what is a waste of time.
