Ramos and Compean Lose 5th Circuit Court Appeal

In a fresh outrage, the 5th Circuit Court of Appeals has rendered a 46-page decision upholding the convictions of Border Patrol Agents Ignacio Ramos and Jose Compean.

Patty CompeanAll convictions were affirmed except those for tampering with official proceedings, which has been remanded for resentencing. In his opinion Judge E. Grady Jolly (a Reagan appointee) wrote: “We leave the major conviction with the major sentence … untouched.” He continued, “The underlying crime of violence with which the defendants were charged is assault within the special territorial jurisdiction of the United States. Once the defendants were charged by the government and convicted by the jury under this statute, the district court had no discretion but to impose at least a ten-year sentence.” 

Court observer Edd Hendee’s analysis raises some concerns. Being present at the December 2007 hearing Hendee says this overly late decision — which should have been rendered in 60 days, not eight months — is not compelling and contains “conflicts of common sense and clear intent of the law.”

Hendee recorded these observations back at the December 2007 hearing:

•    Judge Jolly openly stated it “does seem the Government over-reacted” in this prosecution"
•    All 3 judges aggressively went after the 924C gun charges pointing out that there are no other cases where law enforcement officers were charged with this crime
•    Judge Higginbotham asked U.S. attorney if every policeman who was accused of using unreasonable force should face 924 C charges or were they discretionary;  Judges strongly disagreed with the application of the 924C charges.
•    The judges further raised questions that the witness Davilla was not a low level mule but routinely ran drugs and would have likely carried a weapon in the daily activities of smuggling drugs.
•    There was NO indication that the judges considered the U.S. Attorney’s discretion reasonable or that the 924C gun charges were warranted.

Regardless of their sentiments back in 2007, the court has raised a red flag with their opinion, and by not agreeing that the defendants should have been able to introduce evidence of Osvaldo Aldrete-Davila’s second alleged drug-trafficking incident in October 2005 (months after the February 2005 incident.) And regardless of their own 60-day goal for reaching a decision, the black robes’ eight-month hiatus could also be viewed with great suspicion, given that their previous statements are contradicted by their conclusion, that:

For the most part, the trial of this case was about credibility, and although the jury could have gone either way, it chose not to believe the defendants’ version of the crucial events of February 17. The trial of the case was conducted fairly and without reversible error.

Heartbreakingly, Ramos and Compean remain in solitary confinement, their wives and families devastated emotionally and financially.

Unless enough pressure comes to bear on the White House, this stomach-wrenching affair may never be righted. Pardons and commutations are political and not based on merit. So, even with top republicans now demanding a commutation, the White House continues to sidestep the issue. When Sen. John Cornyn approached White House spokeswoman Dana Perino on the subject, she responded: "There is a process in which people in our country can ask a president of the United States for a commutation of their sentence and that process can take place if those individuals want it to."

How likely is a presidential pardon? The answer: not very. While the president found time to pardon his pal, Scooter Libby, and to contemplate pre-emptive pardons for administration officials in the increasingly unlikely event Congress might demand accountability for wrongdoing in the areas of torture and illegal wiretapping, he is unlikely to get around to pardoning officers Ramos and Compean.

Petitions for commutations are submitted to the Justice Department for investigation and review, but the Justice Department is presently two or three years behind in authorizing the first step of investigations. Meanwhile, the most egregious perversion of the American legal system in recent memory remains, a mockery of the idea of justice.

Bush will never pardon them because he is a staunch supporter of the very open border anarchy Ramos and Compean sacrificed themselves to prevent. You want a conspiracy? This is as conspiratorial as it gets. God forbid we offend our neighbors to the south by enforcing our laws.

To think that we actually afforded that reprobate, murdering drug dealer amnesty to come and testify against our own brave defenders! Have we gone mad? I am a Republican and a conservative, but I'll be damned if Bush represents me or my family, and I will NEVER pull a lever for McCain. I don't care if it means Obama wins. Maybe an Obama presidency will remind Americans just how far we have fallen. When government becomes this corrupt and unresponsive to the will of the people it is time for change alright. I'm so mad right now I'm ready to march on Washington all by myself. This madness has got to end.

Our government and its politicians make me want to vomit. We have a case here, where two men were doing a job that we need to be done down at the border. Along comes our President and Mexico's politicians who get together and decide the fate of two very good, law abiding agents. We at ct-onfire and other organizations have drawn the battle line in the sand. The war is on, we may have lost this battle but we have enough people and battle plans to win the war against corrupt governments,politicians and greedy business money mongers. Watch out Cheney,Bush,Rockefellers,Clintons,Fox,Martin etc... We know what you are trying to do to "Our America" and its not going to happen on our watch. Pray for your "bank accounts", cause the lord is coming to smite you all. With a little help from true "American Citizens" Amen....

These men- heroes of the republic- and their families have not been forgotten by what remains of the free people of this country.

The larger agenda of consolidation of this hemisphere will be undermined by a Bush pardon of Ramos and Compean and so- unlike Mr. Bush's criminal friends covering up for crimes against this republic with respect to the War and illegal spying, et al- they will not be pardoned.

Let's add the illegal and continued unjust imprisonment of these men to "President" Bush's impeachment!

Doing what the John Birch Society should have done 3 years ago, Dennis Kucinich has launched his own impeachment campaign against this criminal president.

On behalf of Ramos, Compean, and their families, we should support it!

This is a clear case of the government wanting to demoralize any effort to secure the border against dangerous criminals. The JBS is correct in saying the true goal of President Bush is the integration of US, Canada, & Mexico. No wonder he won't uphold his oath of office and protect America from an invasion.

How is this ruling an outrage? Ramos and Compean are government officials who fired their weapons on a FLEEING, UNARMED, SUSPECT. That's pretty much the definition of tyranny and cowardice. Running from the police is rightly a crime, but it is not punishable by DEATH, which is the likely result of firing pistols at someone. The man who was fleeing was a drug smuggler, but neither is drug smuggling punishable by death, AND HE WAS A SUSPECT. When police can shoot at unarmed civilians for running away or because the police SUSPECT them of a crime, that is tyranny. It seems like almost every day we see some police officer using tasers or attacking citizens abusively and being protected by higher ups. This seems to me like a rare example of accountability within the system. Ramos and Compean could rightly be tried for attempted murder, they're getting off too easy if you ask me. It's funny how a supposedly anti-Communist organization like the JBS is inhabited by so many people who seem to want an East-German type wall patrolled by guards who shoot first and ask questions later. That's Communism, folks. Here's a suggestion; if you want less illegal immigration, demand enforcement against people who HIRE them.

This was a KNOWN drug smuggler. He was NOT innocent. Border patrol agents have so much against them how do you expect them to do their job? It's nothing but government intervention to allow drug smugglers somewhat unlimited access to America's borders. So when the suspect was fleeing DISOBEYING border patrol agents, a chase ensued. Tensions were raised.

At one point they thought he had a gun and shots were fired. Are the agents supposed to wait until they get shot first before firing? There's some cities that way and we're losing police officers because of it. One agent didn't think he hit the suspect so he didn't pick up his casings. First of all, why would you pick up your casings unless you're guilty until proven innocent? The 'normal' way of how things are done in America today.

This guy was an illegal. He does NOT have Constitutional protection. Maybe some whacked out judge who forgot what the history of the Constitution is and said illegals are protected but that's a gross misinterpretation of law.

If liberals keep this up, we'll have all law enforcement agents so demoralized they won't be able to follow the law. They'll be so busy studying how judges twist everything around so they won't be prosecuted.

It is o.k. for our militant police agencies to break into citizens homes and gun them down "by mistake", but it is not o.k. to shoot criminal felons, expecially George Bush's drug runners. Madam,

I normally do not bother bickering back and forth in forums like this because the discussions usually break down into illogical backbiting and name-calling. However, your erroneous calling of my idea "big talking" is just that, erroneous, for it was, and is not, mine, and further is not based in an understanding of past historical events as they relate to the idea of impeaching Bush.

The JBS *did* in fact contemplate an impeachment campaign against GW Bush about three years ago and ultimately chose not to proceed on grounds that its members finally sidelined the idea. For whatever reasons, the leadership of the Society chose- at least supposedly- to respect the membership and proceed on with other matters.

However, what makes it more interesting, and what also puts the illogicalness into your indirect swipe at me, was that at least *some* of the reasons JBS wanted to launch an impeachment campaign against Bush are some of the same reasons Kucinich is doing so now.

And as an aside, I am very aware that an equal comparison between Kucinich- a far Left congressman- and the constitutional outlook of the Society are light years apart on most issues. And rightly so. Therefore, just to make it plain, so that there is no misunderstanding, I am no fan of Kucinich whatsoever.

However, whatever the strategic or tactical ill-timing, Dennis Kucinich doing what the JBS should have done when it could have made a much greater difference, serves to send a message to the Establishment brotherhood that there are still those of us out here who will not forget their crimes, and who remain ready to hold the wielders of unconstitutional power accountable, whatever their time remaining in power.

And that is an appropriate, and constitutional, application of Congressman Kucinich's office, whatever his other way-liberal philosophy may incline him to.

Here endeth the rebuttal.

GW is acting on the behalf of the Mexican government. If we are to have A one world government,he must run interference for Mexicans illegal or otherwise. Ramos and Compean are political prisoners. I pray for their release and hope someday Johnnie Sutton ends up behind bars..GW lacks a soul as his Father before him. How does he sleep at night? Oh yeah,upside down hanging by his ankles.

Yes, and...

I am also aware of the fact that the JBS launched a campaign to impeach President Clinton as well... but it was not because of the effort of the JBS that he got out of his presidency, as we know.

I think when it comes to such actions as impeachment of the President, it needs to be done instantly and effectively FROM THE FIRST ATTEMPT.

...After all, people may not take you seriously if you are attempting to impeach every President at some point, right??

To impeach Bush NOW is not even a realistic idea, thus your comments sound more like adolescent bravado, rather then a strategic suggestion, offering not just the plan but also a 'plan B' if needed...

When Presidential impeachment takes place, there becomes a hole that needs a patch. The primary goal should not be making holes in our country's leadership at a vulnerable for America time...

If anyone's heart desires protests, marches, big crowds, shaking posters and loud chanting - all for just the romance of it - then I mind you, that this is a tool sometimes very helpful and should be used for a correct cause in correct timing and not as a hobby or sports in our daily lives and inappropriately.
