The Donofrio case worked its way up through the State Courts and is set for a Conference with the Supreme Court on Dec. 5. Still and uphill battle if the SC will take this on. But it challenges the NJ Secretary of State for failing to do her job under State law and vet the candidates before placing them on the ballot.

More promising is the case filed by Alan Keyes in California Sacramento Superior Court. Most of the 17 lawsuits that have been filed around the US have been dismissed on technical grounds saying a Citizen does not have standing to bring such a suit. At not time has Obama appeared and produced a copy of his records to answer this question. The main stream media have had a black out on this issue. McCain had the same question and there were massive coverage on the issue including articles in the New York Times that goes back to February of this year. Note who was part of this? Mr. Obama. He was under the same challenges at the same time but there was not a whisper of it in the media. Mr. Obama could have taken the opportunity to stand up and say," I have a similar challenge and I here are all of my records, please vet my qualifications and issue a similar ruling."

What was Obama's response to produce a copy of a Certification of Live Birth to several liberal websites like factcheck, fightthesmears, and others. They dutifully stated that they have held the document, it is real and proves Obama is a "natural born citizen" as defined under the Constitution and hence eligible to hold the office of the President. Nothing could be further from the truth. Simply put the Certification of Live Birth that the Obama campaign posted is, according to the Department of Hawaiian Laws and Health Department, not the same as a Certificate of Live Birth, which is the document that is needed to authenticate Hawaiian birth. So it does not matter if the document produced on factcheck is real or not, the document that is needed is the Certificate of Life Birth. That would show the name of the hospital where he was born, the names of the doctors etc. In order to produce the birth certificate Obama would be required to sign a release and pay $12.00 which he has refused to this point to do. Obama appears ready to risk a Constitutional crisis over a $12.00 birth certificate.

This issue can be challenged in State Court. Go to the Keyes case on the Sacramento Superior Court Website and read the Writ of Mandate. Keyes is represented by Gary Kreep who is a very fine attorney and he has laid out the State law issues very clearly. The Keyes suit names Obama, Biden, Deborah Bowen the California Secretary of State and the 55 California Democratic electors. Deborah Bowen will have to present the evidence that was used to vet Obama to place him on the ballot. If it is found wanting she will not be able to certify the electors and they will not be able to cast their votes for Obama. As Keyes was on the ballot in California he is not susceptible to the lack of standing/no damages arguments that the other lawsuits were dismissed under.

This is section 3 of the Twentieth Amendment read it very closely:

Section 3. If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term,or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.

As noted Mr. Obama is not the President Elect until the Electors have voted for him. There written plainly in the Twentieth Amendment is a provision for were a President Elect canbe found to be unqulaified even after congress votes on him up to the time when the President Elect takes the oath. That begs the question who has the constitutional authority to unqualify a President Elect? To me there is only one answer: The Supreme Court. Since the Qualifications for President is Constitutionally Mandated it is then a matter of Law since the Constitution is the Law of the land. The Supreme Court is the primary court when dealing with Constitutional law. With that bearing in mind you can make a case that the Supreme Court has not only the right but the duty to verify a President Elect is qualified to be President. Congress has it role in the initial voting but as stated by the Twentieth Amendment the President Elect can still be found Unqualified. With that the Executive branch will be out do to conflict of interest, the only branch left is the Judicary with the Supreme Court in the lead. I believe this is why Justice Thomas is taking Mr. Donofrio's case to conference. I believe he knows and accepts it as his Constitutional duty.

1) The New Jersey law requiring presidential candidates or officials of their respective parties to certify the candidate\'s qualifications to hold office only applies to those candidates who are not members of the Democrat or Republican parties. If this were not the case, there would be a signed certification covering Barack Obama sitting somewhere in the NJ Secretary of State\'s office and this, or the lack thereof, would be cited as evidence in lawyer Donofrio\'s filings.

2) The suit in California brought on behalf of grandstanding professional fundraiser Alan Keyes cites no state law or statue that the Secretary of State or other defendants have violated, or in a \"precrime\" sense intend to violate. The suit simply demands that the Secretary of State follow some vague duty to be fair and place a Democratic candidate under the same scrutiny that has been arbitrarily applied to 3rd party candidates in the past.

3) We don\'t have a president-elect until the Electoral College meets on December 15th. Since the electors\' ballots are sealed, we don\'t officially know who that president-elect is until the ballots are opened in the US Senate on January 8th.

4) It would be an unprecedented event if even only 2 or 3 Democrat electors abstained from voting or cast a vote for a person other than Barack Obama. This would put tremendous pressure on the 111th Congress to demand an answer on the citizenship question before the counting of ballots in the Senate is completed on January 8th.

5) For those who are serious about this issue, rather than being distracted by frivolous lawsuits/fundraising publicity stunts, there are 538 electors and 535 members of the 111th Congress that you can choose from to work with in resolving this issue legally. Any Supreme Court action prior to these two groups completing their legally mandated work would be a usurpation of power by the court.

An elector pledged to Barack Obama living in a state that requires by law that he can vote no other way, or be fined for voting another way, would have standing to bring a lawsuit against that state, its Democrat Party or Barack Obama for putting him in the position of having to vote for someone he is not sure of being a qualified candidate. The elector could claim that he is being forced into a position of becoming liable for a lawsuit against himself for failing to faithfully carry out his duties as a member of the Electoral College.

The SCOTUS has NOT made a decision, It takes 4 judges on the SCOTUS to approve the writ of cert. I believe this will happen. This is a constitutional issue so it is extremely important. I do not believe the SCOTUS will let this slide.
